ACTION FOR DAMAGES
FALL OVER CLIFF A claim for £ 1,000 damages as the result of a motoring accident occupied the attention of Mr. Justice Herdman in the Hamilton Supreme Court yesterday, when Ernest William Moisley driver, sued Day’s Motor Services, Ltd. The statement of claim set forth that while plaintiff was employed by defendant company the car he was driving plunged over a cliff on the Taupo-Wairakei Road and fell 120 ft. Plaintiff had his right hand injured and suffered from shock. It was alleged that the accident was caused by defective steering gear which the company had failed to repair. For the defence it was alleged that the steering-gear was in order and that plaintiff was travelling at excessive speed.
On the evidence the judge gave the judgment in common law against plaintiff. Counsel will consider plaintiff’s claim under the Workers’ Compensation Act.
