KNOCKED DOWN BY CAR A sequel to an accident in Dominion Road on the night of January 30 last was heard by Mr. Justice Herdman in the Supreme Court this morning, 'when Una Comeskey (Mr. ’Conlan) sought to recover £509 17s damages from Percy Roy McMahon (Mr. J. F. W. Dickson). Counsel for plaintiff stated that his client was a trained nurse who was in receipt of £4 4s a week prior to the accident. It was 8.30 o’clock on the night in question that the plaintiff was waiting for a tram at a stop near King Edward Street, Dominion Road. It was not a compulsory stop, and persons wishing to board a tram were required to signal trams. As the tram approached the plaintiff left the footpath and moved toward the tram rails. A motor-car appeared behind tile tram and, overtaking it at a high rate of speed, knocked down the plaintiff. She saw the car coming and moved a step nearer the tram rails, putting one foot on the rails to denote her intention. But the car swerved and struck her. She received severe injuries, and since that date had not been able to carry out her professional duties. She claimed, therefore, £lO9 17s special damages, and £4OO general damages, or in the alternative, £509 17s general damages and costs. Counsel pointed out that the defendant had been convicted and fined 40s for negligent driving. Lengthy evidence is being called, and the case is proceeding.
