APPEAL CASES

HAMILTON SUPREME COURT (Prom Our Own Corespondent.) HAMILTON, To-day. Reserved judgment was given in the Hamilton Supreme Court to-day by Mr. Justice Herdman, in the case of R. G. Vivian v. William John Eynon, on appeal by Vivian against a judgment of Mr. F. W. Platts, S.M., at Morrinsville. The action concerned a promissory note for £4O, which was banked by appellant. His Honour, in granting the appeal, held the appellant should have been informed as to the secret arrangement by the man to whom the bills had been given to pay off a prior debt. The appeal by H. Eva to upset an adjudication order made against him in bankruptcy was upheld in a judgment delivered by Mr. Justice Herdman In Hamilton to-day, on the grounds that 11s for costs of an unsuccessful distress warrant was wrongly charged.
