The plaintiffs claimed that their lease of a house at St. Heliers Bay, owned by Mrs. Sale, had been terminated unlawfully, and £SO worth of chattels had been disposed of. Mr. F. W. Schramm appeared for plaintiffs and Mr. R. J. Coates for the defendants. Mr. Jarvis, in evidence, said that he had leased the house and during the temporary absence of his wife had sub-let it. There was a dispute concerning the rent, and although witness liad offered Mr. Sale £ 5 as rent, this was refused, and defendant took possession of the house, and sold witness’s chattels at auction.

When witness had offered Sale money, Sale threatened him with a 141 b strike hammer. * Edmund Sale said that when Jarvis called on him he was full of threats, and hinted that he might “do for” the witness.

“I was so frightened that I called out—“Help—Murder,” he added. The magistrate, Mr. W. R. McKean, S.M., was not satisfied with plaintiff’s account of the interview with Sale. Judgment was given for defendant.
