AN AWARD AMENDED.

PROPORTION OF EMPLOYMENT. Upon the joint application of the parties to the Northern, Wellington. Nelson, Westland, Canterbury and Otago and Southland Motor Mechanics’ Award the Arbitration Court has ordered the award to be amended to provide that boys may be employed in the proportion of one boy to four men, or fraction of four men, at all classes of work covered in sub-clause (e) of clause 1, excepting the assembly of new cars referred to in the clause; also that boys may be employed in the same proportion in all classes of work covered in sub-clause (f) of clause 1. The wages of boys referred to in subclause (e) and (f) shall be as follow:

A further alteration is the amendment of clause 7 by adding an order that workers coming within the scope of the clause who work no fewer than 26 Sundays and no fewer than half the holidays prescribed in the award, shall be allowed one week’s holiday in each 12 months, on full pay. A clause has been added to the effect that the award shall not apply to any employer who does not undertake any work coming within the scope of the award other than the supply of petrol and oil, provided that his workers were covered by the provisions of some other award or industrial agreement under which his principal business is carried on, provided also that this exemption shall not extent to the employ er of any worker substantially employed as a petrol and oil attendant. A memorandum states that the amendments were agreed to by the parties and that at the request of all the Court drafted a new clause (23) to cover the position of those bowser proprietors who sell oil and petrol only as a sideline in connection with some other business. Under this provision an employer who does not employ any worker substantially as a petrol and oil attendant is bound only by the provisions of the award under which his principal business is carried on. This will necessitate the payment of overtime rates to workers employed outside the prescribed hours. If such an employer decides to employ a worker or workers substantially for the sale of petrol and oil he will be bound by clause 7 of the award.
