A RIGHT-OF-WAY CASE The Chief Justice, Sir Charles Skerrett, gave judgment to-day in the case brought before him on May 24 in which Alfred Moore, mercer, Karangahape Road, contested the right of R. M. Dunn, dairyman, Karangahape Road, to drive across a strip of land vested, in fee simple, in the plaintiff. . The defence admitted that there was no right to an easement over the land, but claimed that under the circumstances the court should not gTant an injunction restraining the continuance of the use of the land, but should grant damages for the trespass. His Honour gave judgment for the plaintiff, awarding him £5 damages for past trespasses and an injunction to restrain defendant from further use of the right of way.
