SCOPE OF ARBITRATION
INQUIRIES FROM BRITAIN PROVISIONS OF ACT Press Association WELLINGTON, Thursday. The Federation of Chambers of Commerce of the British Empire is preparing a report for submission to the Congress at Capetown in October, and has addressed inquiries to the Wellington Chamber; —(a) As to whether the New Zealand courts would give effect to a submission to arbitration when the latter takes place outside New Zealand and both parties are subjects of the countries which have acceded to the League of Nations Protocol on arbitration clauses; (b) whether the courts would give effect to arbitration outside New Zealand to which the Protocol does not apply. The Attorney-General has replied that the Supreme Court will give effect to arbitration in any part of the British Dominions, or in any foreign country, whether they are adhering to the League’s Protocol or not, where one party is a resident here and the parties have agreed to submit matters in dispute to that jurisdiction; also, that the jurisdiction in the case of nations not adhering to the Protocol is discretionary. The Act of 1922 provides for the registration of awards outside New Zealand and makes them effective as judgments given in New Zealand.
