TENANT’S REFUSAL
WOULD NOT LEAVE DAMAGES FOR LANDLORD Claiming £lll 10s for damages alleged to have been suffered through defendants refusing to give up possession for a month of premises at Ponsonby Road, of which plaintiffs had a lease, Hugh Michael Alder and James Edward O’Shea, motor engineers, of Auckland, proceeded against Morley’s, Ltd., second-hand dealers, at the Supreme Court yesterday. His Honour Mr. Justice Skerrett, Chief Justice, presided, and there appeared for the plaintiffs Mr. J. D. Willis, and for defendants Mr. H. A. Horrocks. Defendants counterclaimed for £2OO general damages and £sl 16s 6d special damages. After evidence lasting the greater part of the day had been taken, judgment was given for the plaintiffs on the claim, for £75, together with costs on the lowest scale, witnesses’ expenses and disbursements. Judgment was also entered for plaintiffs on counterclaim, with cos!:s, one fee being allowed on claim and counterclaim in respect of preparation for trial and for hearing.
