DOMINION AWARD In his memorandum on the joint application for the amendment of the Northern, Wellington, Nelson, Westland, Canterbury, Otago and Southland motor mechanics’ award, Mr. Justice Frazer states:—“The amendments to clauses 1 and 7 were agreed on by the parties. At the request of all interested parties, the court has drafted a new clause (23) to cover the position of those bowser proprietors who sell oil and petrol only as a side-line in connection with some other b lsiness“Under this provision, an employer who does not etnploy any worker substantially as a petrol ajid oil attendant is bound only by the provisions of the award under which his principal business is carried on. This, of course, will necessitate the payment of overtime rates to workers employed outside the prescribed hours. If such an employer decides to employ a worker or workers substantially for the side of petrol and oil he will be bound b> clause 7 of the award.”
