APPEAL UPHELD

AFFILIATION CASE DECISION RESERVED An appeal by Thomas Melrose, dredge haod*of Whakatune, against an affiliation order made against him by Mr. Hendrick, S.M., at Whakatane in January last, was upheld by His Honour Mr. Justice Herdman at the Supreme Court this morning. Mr. D. Chalmers appeared for the appellant and Mr. R. M. Grant for the respondent, Alice Larsen. His Honour said he found that three dates had been set up by respondent, March 3, March 17 and March 28. He held that the medical evidence had established that March 28 was not the right date, while the evidence of appellant established the fact that he was elsewhere on March 3. In regard to March 17, His Honour said he was unable to accept it as established that intimacy occurred on that date.
