JURY’S AWARD SET ASIDE NONSUIT POINT UPHELD Press Association GREYMOUTH, Wednesday. His Honour Mr. Justice Adams gave reserved decision in the compensation claim heard at the last sitting of the Supreme Court here in connection with the death of Peter Carmody, at the Brown’s Creek sawmill, Inangahua, through a fiddling-saw mishap. The claim made was for £3,000 compensation by the Public Trustee on behalf of deceased’s children. The jury awarded £I,OOO. Mr. C. S. Thomas, Christchurch, the defendant’s counsel, raised a nonsuit point, which is now decided in the defendant’s favour. The jury’s award has been set aside on the ground that Carmody’s death was caused by his own action in working the saw without authority.
