JURY DISAGREED
NEW TRIAL ORDERED CARNAL KNOWLEDGE CASE Following five hours’ deliberation on the case of 'William Jenkins, charged with unlawful carnal knowledge and indecent assault against a girl 14 years of age, the jury announced that it could not come to a decision. The case was heard by Mr. Justice Herdman, Mr. 3. L. Paterson appeared for the Crown and Mr. J. J. Sullivan for the accused, an elderly farmer residing at Glenfield, Birkenhead. The jury retired at half-past 11, returning at half-past two to ask whether accused had been warned by the detective before giving a statement and what was the legal position regarding such warnings. His Honour stated that the warning was not required by law where a voluntary statement was given.
The jury again returned at 4.40 p.m. stating that an agreement could not be reached.
His Honour ordered a new trial for next week. Accused was released in the meantime on his former bail.
