GOLF ACCIDENT
WOMAN INJURED PLAYER TO PAY DAMAGES By Cable. —Press Association.—Copyright LONDON, Monday. The risk taken by spectators when watching sports was the subject of an action in the King’s Bench Division of the High Court to-day. Miss Cleghorn, who is ignorant of the game of golf, was awarded £l5O damages on account of a fractured cheekbone.
During a game of golf Miss Oldham was criticising her male opponent’s play, and she demonstrated how a certain drive should be made. In so doing she struck Miss Cleghorn, who was carrying her clubs. The defence argued that anyone who went on to a golf course necesI sarily took risks. If the cricketer Hobbs were to hit a ball into the pavilion and the ball struck a spectator, the latter would have no cause of action, as he should have got out of the way. Mr. Justice Rigby Swift, in his summing-up, said there were risks in all games, but if accidents occurred the person injured could not complain to the courts and to the law. The jury decided that Miss Oldham was negligent, and Miss Cleghorn was not negligent.—A. and N.Z.
