By request we publish iu this issue an j addition which the three Consuls, Messrs, j I Zcmbsch,Graves,and Dawson,and Malinina i i Lnupepa and Mataafa have thought (it to ( j make to the Convention of >S -pteaiber | 1879. As an Appellate Court, consisting of the three Consuls, has existed according to the Municipal Regulations for several months past, wo fail to sec what effect this addition to the Convention con have, if it will have any effect, whatever, except to point out that the Appellate Court hitherto existing was informal or illegal. As wo purpose at an early date drawing attention to the Convention,under ! cover of which injustice has been, and will j apparently continue to he, done to the 1 residents in this town, both native and ! , foreign, we will, for the present, content! | ourselves with remarking that in our 1 1 opinion the parti s named above have I i no power to add to or take away from • 1 the Convention: Indeed, it is doubtful i whether some of the Consuls ever had any authority to he parties to (he contract of the 2nd of September, 1879. Wo, the undersigned, hereby agree that the following shall be an additional clause to Article V. of the Convention of I the Second of September, 1870, signed by the Representatives of Great Britain i and Ireland, Samoa, Germany, and the United Stales:— “ And the Foreign Consuls resident in Apia, whose nations have entered into treaty relations with Samoa, shall constitute an Appellate Court to hear ;dl appeals against the deciders of smh | Magistrate.” Done at.
