CONVENTION.
Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, and the King and Government of Samoa heing desirous to make Letter provision for the good government of the town and (lU.rict of Apia, and the preservation of peace and good order therein, as well us for the maintenance of its neutrality, should internal disturbances unhappily take place ill the Sunioau State, have determined to conclude a convention for that purpose, and have named as their plenij otentiaries: Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, itc. :

Sir Arthur Hamilton Gordon, Knight Grand Cross of the Most Distinguished Order of St. Michael mid St. George, Her .Majesty's High Commissioner and Consul-General for the Western Pacific, Governor of Fiji; and Alfred l'ercival Maudslay, Esq., one of Her Majesty's Jleputy Commissioner's for the Western Pacific;

The High Chief Xlalieton Laupepa, and The tiigh Chief Saga, Who having met and conferred with tlio representatives at Apia of other nations having entered into treaty relations with Samoa, that is to say : Corvotten-Capi-tain F. Meusing, Imperial German Xavy, Commaiding 11.1.0.M.5. gun-vessel Albatross, Ttieodor Weber, Esq., Imperial German Consul for Samoa anil Tonga, Captain It. Chandler, United States Navy, commanding U.S.S. Lackawanna, and Thomas M. Dawson, Esq., Consul of the United States of America at Apia, have, in conjunction with thera, agreed upon and concluded the following articles : Article I. The space comprised within tlic following limits, that is to say; commencing at Yailoa, passing thence along tho coast to the mouth of Fuluasa river, thence up the course of the Fuluasa river to the point at which the Alafuala road crosses such river, thence along tho said road to the point where it reaches the river Vaisigo and thence in a straight line to the point of commencement at Vailoa, shall constitute and he known as the Town and district of Apia. The waters of the harbour of Apia are also comprehend within the district.
Article 11. Such town and district shall he placed under the Government of a Municipal Board consisting of those foreign Consuls resident in Apia, whose nations entered into Treaty relations with Samoa. Representatives of every such nation having a Consul in Samoa, shall at a future period be added to the said Roard, and shall ho chosen in such manner, and exercise such functions, as may ho provided by Regulations to he hereafter agreed upon and published by the said Hoar!. Arlkle 111. Tho Municipal Board shall have power to make and enforce Regulations and Bye-Laws, with regard to Police and Good Order, i'ublic Works, Sanitary Regulations, the issue of licences, the imposition of hurbour regulations, the prevention of the sale and supply of spirituous liquors to Samoans, aud other Islanders of iho Paeitic ocean, and other similar matters, within the said district, aud such regulations shall ho binding upon all persons within the said district aud may bo onforcod by penalties not exceeding Two Hundred dollars fine, or imprisonment with hard labour for a period not exceeding six mouths, or both tine and imprisonment not exceeding tho before-mentioned penalties. Article IV. Tho Municipal Hoard of Apia may, for tho purpose of defraying expenses incurred under the above article, levy rates upon tlio occupiers of housos or lands within the district of Apia, not
exceeding Five per Cent annually on the annual asiteased value of such premises as calculated ou the presumed rental valuation thereof, or One per Cent, annually on thai real value of inch property. xrtkk v. All offences against the Regulations of the Municipal Board, by whomsoever coiuuiitted, shall he tried by a Magistrate to be appointed hy tile Board. Article VI. If a subject or citizen of any of the contracting parties in Apia be charged with an offence against the laws of his own country, he shall lit tried according to the jurisdiction provided therefor Ly the legislation of tlie nation to which lie belongs, or according to the stipulations of any Treaty concluded between his nutiou and Samoa. Article VII. Every Sauioan subject charged •with a criminal offence within the limits of the district of Apia,) other than an offence against the Municipal Regulations,) Bhall ho liable to trial hy tho Magistrate appointed under the provisions of article V. in conjunction with a Sauioan Magistrate. Article VIII. The foregoing articles shall ill no way prejudice tho territorial integrity of Samoa, and the Sauioan flag shall ho hoisted at such place of meeting of the Municipal Board as may be permanently adopted. Article IX. In case of civil war tho town and district "of Apia, and the. adjacent districts comprised between the boundaries of the town and district of Apia and Lotogo, Tiapepo Point, and siusega, shall be considered as neutral territory and the Municipal B.aid may frame and issue such regulations as may be considered ueeetsary for tho support and maintenance, of such neutrality. Article X. The present Convention shall bo revised at the eiul of four years from its date, and (if the internal stale—of Samoa at that time will happily admit thereof, without prejudice to the interests of foreign residents in Samoa,, thu powers conferred by the present Convention upon the Municipal Board of Apia, shall tuen cease and determine, and the district again passinuler the Control and autnority of the Sauioan Uovormiieut, or such other authority as may be agreed upon between the Saiuoan Government and the High Contracting Parties.

Art Mr XII. The representatives in-Samoa of the •Lnited States Government provisionally aeeode and assent to the present Convention on behalf of the Government of the United States, subject to the approval of that Government. .Article XIII. Tho present Convention shall be ratified, and the ratifications exchanged at Apia within one year from the date thereof. In witness whereof we have signed the same and affixed thereto our sealß.
