This appeal has now been upheld on the basis of the opinion of Professor Salmond, who says : Speaking generally, the officer should be regarded as entitled as of lig't to the appointment if he is suitable for it in respect to experience, ability, and character, and if he is the best of the applicants. Therefore, to re-, j tain him in the inferior position beI cause his promotion will cause mI convenience in the Public Service I Would not in ordinary circumstances I bo justifiable. If any Department I thinks it necessary to retain an officer in its service, the proper method is to pay him as high a salary a* he is worth in the other Department, and if he is not receiving such a salary his promotion to another Department could not reasonably be objected to. The Board would bo justified in -requiring a strong ease of unavoidable public inconvenience to be made out before depriving the officer of any substantial promotion to which he would bo otherwise en- | j titled.” I i
