ALLEGED FURIOUS MOTORDRIVING. THE CASE DISMISSED. A charge oi' furious motor-driving, arising out of the accident on the .Mountain Road on July 29 laßt , wl, en a motor car driven hy Mr 1. J • Stohr collided with a motor cycle rul'f!en hy Mr Henry Button, an employee of the Simplex Milking Machine Co., was heard at the Stratfoid Police Court to-day. j The case was conducted hy Sergeant Dale, of the local police, and after hearing the evidence, the Magistrate (Mr Haselden), in giving his decision, said:—“l do not think there is any positive objection to the police having taken up this prosecution. it has certainly given some opportunity towards eliciting the circumstances of the case. Hut I am no means certain |that the truth has been laid before 'me. On the evidence, I think a prosecution under section 9 of the (Motor Emulations Act must fail, j Where there is more than one explanation of doubtful circumstances, a criminal court is bound to adopt an explanation consistent with innocence. I* am trying to avoid anything that may he quoted as a finding if there 1 should he any subsequent civil proceedings arising out of this action. That is why I am not dealing with j the matter thoroughly and because it is very possible civil proceedings may be taken I do not wish to prejudice either side by expressing my opinion on the facts. I am constrained to limit my remarks to dealing with it solely on this information which I must dismiss.”
