The defendants named in the writ are Arthur Cleave, Auckland, publisher; Alexander Kccles, Auckland, chemist; Taylor Temple Harrison, formerly of Auckland, company promoter, and now of parts unIknown beyond the seas; George Abbott, Auckland, company promoter; Frank Edward Dobson, Auckland, compunv secretary; Jamc< J. Stitherland, formerly of Auckland, and now of Christcliurch. agent ami company promoter, and tlie Dominion Financiers, Ltd., an incorporated company. The .statement of claim set; out two causes of action. In respect to the first, the claim is made from the defendants, jointly and severally, for £3200 as damages and, alternatively, that defendants should he ordered to account for and pay to the plaintiff company moneys received by them and each of them by virtue of an agreement of .March mil, 1915. The plaintiff company also claims that this agreement should be set aside. In respect to the second cause ol action, the plaintiff company claims From each and all the defendants, other than Dobson.as damages £5200, being the sum paid on the purchase of -1982 shares in Dominion Financiers, Ltd.; alternatively, that the same defendants be ordered to account for and pay to the plaintiff company moneys received by them and each of them by virtue of the purchase of those shares, and that the purchase of the shares be set aside.
