AN “ACT OF GOD.”
PLAINTIFF CETS £225, Per Press Association. Wellington, May 16. At the Supreme Court an action by •Arthur Schaeff against Tingey and Co. 'for the recovery or J.OOO damages, lor injuries suffered by an accident in Willis Street, was heard. Defendants had a contract to paint a building. Two employees left step ladders on a balcony during the lunch liom. Plaintiff was riding past on a motorcycle, ami a gust of wind blew one of t'iie ladddcs" over the balcony railing, ft fell orplkoff, injuring bis bead and shoulder smashing bis motorcycle. VI Defendants contended that all reasonable precautions bad been taken, and their counsel asked for a non-suit on the ground that the wind was an “act of God.” The Chief Justice reserved this point, and the jury returned a verdict for plaintiff for i'225.
