MILKING MACHINE DISPUTE.
SETTLEMENT ARRIVED AT. Per Press ’Association. Auckland. August 20. The-case between the Pidd Milking Machine Company, of, Mew Plymouth, ( Plaintiffs, and the Treloar .Milking Machine, of Hamilton, defendants, in which allegations of infringements of patent were made, and in which an injunction was asked,, was 1 settled in the Supreme Court. The following are the | terms—firstly, the defendants submit to the injunction as played hut the
injunction shall not he deemed to apply tp the triangular inflation, a description of which has been lodged with the Registrar and signed by counsel; and it is declared that!the plaintills do not and will not! object to the manufacture, use, and ! sale of such
inflation. Secondly, defendants are to
he allowed to sell their existing stock of inflations and to pay: the plaintiffs royalty of one, shilling each thereon, but this shall '[not apply to the'inflation expressly excepted iron! operation of first paragraph. Thirdly, ithe defendants are to pay the plaintiff the costs on a scale to he' fixed by'-the Court. Fourthly, the plaintiffs undertake not to take any- proceedings
against bona fide farmers who I ' have hitherto purchased any inflation exhibited. Fifthly, the plaintiffs waive any claim to damages or profits.
