THE CASE OF DUERKOP.

Wellington, April 15

The Court of appeal, consisting of Sir Robert Stout (Chief Justice), and Justices Denniston, Edwards, Ooopei and Chapman, sat this morning to hear argument on the questions re-served-at the trial in February Inst of William Heinrich Magnus Duerxop for illegal trading with the snomy. The jury had found the prisoner yuiUy on four indictments laid under section 35 of "The Regulation of Trade and Commerce Act, 1914," and found a special verdict upon a fifth indictment which was laid under "The lVaiing with Enemy Act, 1911." It appeared that "The Regulation of Trade and Commerce Act, 1014," was repealed on 2nd November, 1914, by "The Trading with Enemy Act, 1914," and proceedings against Duerkop were not commenced until after November 2nd, and counsel contended that as the act had been repealed, the proceedings were invalid. The Chief Justice, who presided at the trial, overruled the objection, and one of the question" for the court is, whether, he wis right in doiiig so. Argument is proceeding-
