The Full Court delivered reserved decision in the claim by the Mayor of New Plymouth against the Minister for Public Works for land.taken for the Stratford-Ohura railway. The Court held that an.entry Upon the land under the provisions of section 180 of the Public Works Act, 1894 (section 200 of the Act of 1908) was not an entry within the meaning of section 70 of the Act of 1908, and where the land was, .after being occupied for some years under section 180, taken for a public work under the provisions of the Public Works Act, 1908, compensation had accordingly to be assessed as at the date of the proclamation taking the land for public works.
