It would be sufIcient to make a declaration to tnat -fleet, with liberty to apply to the .Ugh Court to endorse it by injunction or otherwise. Their Lordships, therefore, advise Mis Majesty that such declaration iioulcl be made, and that such, liberty b apply should he granted, and tnat Hie eider ofvthe High Court should be varied accordingly. As respondents iave substantially succeeded, appellants must pav the costs of this appeal
