A STRONG STENCH.
IN RESTAURANT YARD
THE PROPRIETOR FINED. Dominic Sisarich pleaded not guilty at the Court on Friday to a charge or having on December Bth failed to keep the yard of his premises in Broadway in such condition as not to become a nuisance to the public. Witfiani Lander, manager for It. Hannah and Co.; gave evidence that defendant's premises adjoined Ids firm's. There had been a smell for some time," but on Saturday, Sunday and Mqiiday the' stench was overpowering. On Sunday and .Monday he was violently ill, and the stench was the sole cause." Witness 'on 'Monday looked'over tjie fence and saw one of the restaurant staff, whohi lie asked to have the, nuisance abated. This person asked'witness to see if he could not get something done.' "So' said he had' been ill also. At ordinary times there was only the usual odors arising from a restaurant. ' Sergeant MeNeely said he had visitM the yard, and about fifty feet from the backdoor' there was a box hill of refuse, which was a putrid mass of maggots. A horrible stench arose from it. Twenty feet away from the door ihe're was another box with a lid on •t. "I'wished," said the' Sergeant, "to pass this box 1 , and get to the back toor, but I made several unsuccessful ittempts. The Borough Inspector, whoAvas with me, managed to get past it." ...•■■.

Apparently an attempt had been made o kill the maggots by throwing baling water on them. There was an )verpowering stench arising from the iox. ' There was other refuse in the yards, which was in an insanitary state. W. Barlow,'Borbtigh Inspector, said le had warned defendant that he mould have iron receptacles for his ish refuse. ,
John Francis, sanitary contractor, .aid he paid a weekly visit to all busilessNpremises and would make calls >ftener if paid. He had nwver refused to' make extrii calls at defendant's. T did not," he said, "smell the stuff nuch when it was put on the cart, >ut I smelt it when I got home." Defendant, in the witness-box, said le had asked Francis to call oftener.
