WIN Foil UXIOX COMPAXY. [Per Press Association.] Wellington, July 2. The Chief Justice (Sir Robert Stout) delivered judgment to-day in die case of Carl Kolm, trader, Raratonga, and others, versus the Union Steamship Co., being a claim for damages assessed by giving £836 in respect to the Company’s failure to ship certain fruit to Wellington from Raratonga by the Maitai on February 12, 1912. His Honor held that the shipping of the fruit was contingent upon it being possible for the steamer to observe the conditions of a mail contract, and gave judgment for the defendant Company with costs. A BUILDING COXTRACT. In the case J. and A. Wilson, contractors, against Chas. James Stanton Harcourt, being a claipi for £404 3s Id, a balance still owing on a house built at Hastings, plaintiff was awarded £360 2s lOd and costs.
