WELLINGTON SESSIONS. [Per Press Association.] Wellington, June 13. In the Supreme Court to-day Mr Justice Sim delivered judgment in connection with a motion to dismiss an action brought by Goldfinch 'and Co sawmillers- and timber.merchants, Ohakune, against the Rangvtikei. Sawmillors' ' Co-operative Association. Plaintiffs alleged that the defendant company was established for the< purposes of restraining-trade, maspuch as it had'send'outi jfeircularb.tp its further orders thev had paid the amount owing to defendants Damages for £ISOO were soueht. Defendants counter-claimed for £334 : 14s 6d as"fhe amount owing by plaintiffs, and moved that the action be struck out for the reason tha it was groundless: -Hi* Honored that defendants wbre justified m mak-. ingthe applicatip>,\atidthe v .actmn was struck out, with the proviso, thai the plaintiffs might make an amended claim; £3O costs was allowed.
