the “OFF 1 ’ THEORY. Mi 1 Peter Bowling brought an action against the North Coast “Daily News,” N.S.W., claiming £IOOO damages for libel. When the case came on for hearing af Sydney on Monday week, however, it was found that tho -ase was to he tried by Judge Pring, who sentenced Mr Bowling at Sydney after his conviction on a charge of conspiracy in connection with the coal strike a year or two ago.
Counsel for Mr Bowling suggested that in view of the fact, Judge Bring might not to hear the present case, hub Judge Bring said lie could see no reason why the fact of his having presided ’at the trial referred to should constitute an objection to his hearing this action. He was hot likely to lie influenced by anything that occurred on the former occasion. Mr Sliand, for defendants, admitted lhat he would cross-examine Mr Bowling on his doings in connection with the northern colliery trouble. As bio Honor declined to meet the plaintiff, Mr Lysaght, for Mr Bowling, declined to go on with the case, and the record was struck out, Mr Bowling paying the costs of the day.
