FALSE REPRESENTATION. (Per Press Association.) Christchurch, December 3, .‘At the Magistrate’s Court this morning, H. Cunningham and Percy Welsh were charged with attempting to secure concessions from the Railway Department on false representations. Horses carried to a meeting are brought back free of charge if not sold, .and it is alleged that accused got a certificate for King Try, which, was sold .and sent with another horse back on the same certificate. Cunningham was. fined 60s, and Welsh 20s.

In the Supreme Court at Auckland, Matthew Andrew Ferri, agent and interpreter and formerly editor of tan Australian newspaper, claimed £7OO damages from Tony Martinovitch, gum broker, for alleged slander, false imprisonment and assault. The case arose out of an incident in defendant’s office, which was visited by plaintiff. Def.en^aqt was . called out, for a few minutes and when he returned to the room in which plaintiff was he accused him of stealing money from the safe, detained him until the police arrived and searched him. The money was not found on plaintiff, hut a sum nearly equal to that alleged to be stolen was fotmd in another suit which defendant had at the office. The jury, l after half an hour’s retirement, found that defendant had falsely im prisoned, Ferri, and had assaulted him by causing him to be searched, though they found, for the defendant on the count of alleged assault by attempting violence.. For the false imprisonment they awarded plaintiff £5, and on the other': count one farthing damages. His Honor awarded costs on the lowest scale for the plaintiff on the two claims, which he had won, and against him on the middle scale on each of the five other counts.
