LAW JO TAKE ITS COURSE. (Per Press Association!) Wellington, Last Night. A meeting of the Executive Council at which the Governor presided was held on Saturday to further consider the case of Tahi Kaka, the young Maori now under sentence of death at Auckland for murder. The decision of the Executive is that the law must take its course. It is officially stated that no circumstances which could he considered favourable to, the prisoner were excluded from the Council’s deliberations. LIBEL ACTION SETTLED. ISITT V. STEWART. (Per Press Association.) Christchurch, Last Night. A settlement lias been arrived at in tlio libel action, L. M. Lsitt v. J, M. Stewart, as follows: The jury awarded £SOO damages, subject to the decision of the judge on the questions of law raised at the trial. The defence pleaded that the publication of the Rev. lsitt’,s name in the trade list was a privileged one, and that members of the Association wore entitled to acquaint one another with the names of persons who wove entered in the list and circulated amongst the members. The judge reserved his decision on the question of privilege and no damages would have had to be paid by the defendant to plaintiff until the judge delivered bis decision on that point in plaintiff’s favour. In. the meantime, the member of the Association who gave Mr Isitt’s name for insertion in the trade list arranged with Mr lsitt to pay him £lO and both his and defendant’s costs, in consideration of Mr Lsitt abandoning any verdict which he might obtain against Mr Stewart, also refraining from taking any proceedings against the said member. Tins course Mr lsitt agreed to, as be had brought the action for the purpose of clearing his character and credit and not for the purpose of obtaining heavy damages. The matter will therefore ho settled on these terms.
