HEAVY DAMAGES
SEQUEL TO COLLISION

Wanganui, May 20.
After a retirement of three hours tonight at the end of the third hearing bf the case in which Herbert Frederick Benson claimed £5OO general damages and £134 special damages from Kwong Chong as a result of a motor collision, the jury awarded £lOOO general damages and £134 special damages. In February last Mr Justice Reed and jury awarded the full claim of £634, but counsel moved for a new trial on the grounds that the verdict was against the weight of the evidence. To-night the jury found that defendant’s driver was driving at an excessive speed, but. not on the wrong side of the road. Plaintiff was not negligent in cutting the corner of the street, but was negligent in attempting to cross another street of the intersection. The jury found that if both were negligent, neither up to the last moment could have avoided the accident. Defendant’s driver could have avoided the accident by' the exercise of ordinary care.
