In thia caae the facts were admitted, being that James M'lntoah, a settler of Limestone Plains, had ma le an asjre.3ment with defendant to sell him a double furrow plough for £18, and to purchase of defendant a waggon for £34 10s. M'lntqsh delivered the plough but did not take away the wag»on, and afterwards became insolvent. Plaintiff (as trustee in M'lntosh's estate) applied to defendant, tendering him £16 109, and asking for delivery of the waggon. Defendant refused, hence the action to reoover the amount stated, as the value of the plough.
