COURT OF APPEAL.

Thomas Fitzgerald, appellant, Harry Creasy, respondent. Mr Wade appeared as counsel for appellant, and Mr Harvey for respondent. This waa an appeal from the decision of the Warden's Court at Orepuki, and originated in a disputed right to a wate»-rac#. Mr Wade opened the case, and called Mr Warden Eogers, of Orepuki, and put in evidence the titles of parties and certificates. Michael Fitsgerald was also called. Counsel having addressed the Court, His Honor gave judgment for respondent with counsel's fee, £5 ss, on the ground that the appellant, Thomas I'itzgerald, had nol in the court below proved any right prior to that of Harry Creasy.
