RELEASE OF BRIGHAM YOUNG.

A despatch from Salt Lake City, dated 25th April, which appears in the New York papers, says : — " The motion to release Brighaua Young on Habeas Corpus was argued to day before the Mormon Probate Court, the Territorial AttorneyGeneral for the petitioner, and the Deputy United States Attorney- General and E. Gilchrist for the United States Marshal. The motion was resisted on the ground that the Probate Court is an inferior tribunal which could not review the proceedings of the District Court. It was also objected that the Probate Court had no power to release a prisoner held by a United States officer under judicial process. The Probate Judge overruled all objections, 'holding that the proceedings of the United States courts in the territory during the past two years have been illegal ; and he expressed himself as firmly and. unalterably of opinion

that the people of the territory have a right to govern themselves ; that the Supreme Court in the territory has abused and] transgressed its powers, and he would not respect any of its decisions. It was therefore ordered that the prisoner be released. The counsel for the United States Marshal entered a solemn protest against the ruling of the Court, and gave notice that the case would be carried upon certiorari. Brigham Young was present in court, and when the decision was announced was cordially congratulated by his friends."
