Monday, 20th May. (Before F. M'Culloch, Esq., E. M.) Quin v. Manning. — A claim for £1 10s for cartage of goods to Eastern Bush from Riverton, £1 5s for conveyance of two passengers, and £6 10s for cartage of a number of rams from Invercargill; in all, £9 ss. The goods it appeared were token to the Eastern Bush, but the agreement had been to take them to Wild's Accommodation House, on a certain day, to meet a dray going to defendant's station. The rams were never conveyed at all, the order to do so being countermanded by defendant. The agreements throughout were verbal, and as usual in such cases the evidence was somewhat conflicting. Judgment for plaintiff, 20s, being the cost of conveying the passengers, each party paying his own costs. Bank of New South Wales v. Hare and Pratt. — Judgment in this case had been reserved from Thursday last. The question was whether the whole or only the upper floor of the store in Tay street, formerly known as Alaningand Whitton'a, had been rented by defendants at 20s per week, and for six monthß. It was claimed for plaintiffs that the agreement only extended to the upper floor, and was not for any specified period. Kent was demanded for seven weeks at 20s for each floor, and for one week at £3 for the whole, in pursuance of a letter which had been sent to that effect to the defendants. The agreement in this case was in the first instance a verbal one, though defined, subsequently to the defendants taking possession of the building, by a letter from Mr Eraser, representing the plaintiffs, to which, however, defendants did not repiy. Judgment for plaintiffs for £12, being 20s per week for the upper floor, and 10s per week for the lower, for S weeks, with costs, £2.
