(Before H. M'Cxtllocs, Esq., E.M.) "Weditesdat, 24th Apbix. Monaghan v. Monaghan. — Mr Wade appeared tor plaintiff. This was an action to recover £10, ironoy lent. The parties were brothers. As the defendant did not appear, the case was heard in his absence. After hearing the evidence of the plaintiff and a third brother, Patrick, his Worship gave judgment for plaintiff, with costs. Thursday, 25th Apbil. ' David Thompson was brought up charged with three assaults, committed under the influence of drink, at the Half-way Bush Accommodation House on the 26th January last, namely striking Jessie Simmons, niece of the proprietor, Mr M'lntoah, on the head with his hand ; striking Hugh M'lntosh, on the head with a stick ; and striking James Harvey with a stick on the arm. The prisoner pled guilty to all the charges. It appeared from the statements of Mr Mlntbsh and Mr Haroy that the assault on Mr M'lntosh had been of the most serious hind. He wns badly cut on the back of the head, his face marked in Beveral places, and his head and face covered •with blood, when Mr Harvey saw him. The stick which, he used was produced, and. was certainly a formidable weapon. After rendering M'lntosh some assistance, Mr Harvey and Mr Stock went to the stable to get their horses. The prisoner followed them, and attempted to strike Mr Harvey's horse with a broom handle. On being remonstrated with he aimed a violent blow at Mr Harvey's head, which Mr Harvey received on his arm, knocked the man down, and with Mr Stock'a assistance, secured him by tying his hands. He advised M'lntosh to keep him secured until the arrival of the police, as he seemed absolutely mad with drink, and appeared likely enough to commit inur.ler. However after he and Mr Stock had got on their horses, a man named Evans let him loose, and he got away. The only provocation he had received was that M'lntosh refused to supply him with more liquor. For the assault on Jessie Simmons, prisoner was sentenced to seven days' imprisonment ; on Mr Harvey, seven days ; and on Mr M' ld tosh, six weeks, all with hard labor.
