Judgment by default for pl'-intiff, with costs. Jr (Tips v. Flint. — This was an nrti->n to recover the ?um of £6 ), being th > value of three horses alleged to have been illegally detained by defendant. Mr MadonaW, for the defendant, applied f r an adjournment of the case on the ground of the ahsence of a material witness. It appeared that the witness, who resides in town, had left unexpectedly the previous day, and consequently had not been served with a subpoena. Hi* Worship was at first disinclined to grant the adjournment, on the ground that as Ihe subpoena had been issued ten days, it might have been served sooner, but ultimately agreed to the application on defendant paying the costs of the adjournment, and expenses of a witness from Winton, amounting in all to £1 2s. The case was a 'journal to Monday.
