RESIDENT MAGISTRATE'S COURT.
♦ Before H. M'Ctjlloch, Esq., R.M. Monday, 22nd January, labceny as a bailee. Henry J. Wheeler was charged on remand from Saturday with the above-named offence. Inspector Pox prosecuted, and ill* Matthews appeared for the prisoner. J. C. Wild, an accommodation-house keeper at Mount Pleasant, near ftiverton, deposed that on Saturday, the 13th instant, the accused applied to him for the loan of a horse to go to Riverton. In pursuance of that application, he gave him the animal produced at Court, also the saddle, bridle, and stirrups, with which lie (prisoner) left the following day. The agreement was that th a horse should bo returned on the Monday. Hot having returned on the Tuesday, witness became uneasy, and sent a note to a party in Uiverton to look after the horse, and if possible take possession of it. An answer was returned that prisoner had gone on to Invercargill, taking the horse along with him. On the Friday, prosecutor received a communication from the police, which induced him to go to Invercargill, when ho discovered the horse, which had been sold to Mr Tulloch. The saddle and stirrups had likewise been sold to a different party, but were subsequently recovered by the police. He valued the horse, saidle, bridle, and stirrups at £15 Bs. The witness was cross-examined at some length, with the view of showing that a joint agreement existed between prosecutor and prisoner, for the manufacture of cordials, and that the horse formed part of the venture. Tae agreement relating to the manufacture of the cordials was admitted, but the witness denial that the horaa formed any part of that agreement. .Prisoner was committed to taki his trial before the Supreme Court, bail being allowed ia two sureties of £15 each, and hhnaalt' in £$d.
