the erection of any sawmill, and att regards shape and frontage lines shall be subject to the provisions ofthe 30th, 31st and 32nd clauses of •' The Southland Waste Lands Act, 1865." "Within fourteen days the "Waste Land Board shall determine whether such application be granted or refused, and if granted, the applicant shall forthwith deposit vyith the Receiver of Land Revenue the sum of fifty pounds. "Within-tbhirty-days from the. payment of the deposit the Chief Surveyor shall cause the application to be surveyed, and its boundary lines cut. The survey on its completion shall be submitted to the Waste Land Board, and, if approved, the Chief Commissioner shall demand of applicant the first instalment of rent, and on its payment, shall issue to him a license conferring on him the exclusive right of cutting timber over the said land, but the money paid as deposit shall be ■ forfeited in case the first instalment of rent is not paid on demand. The expense of such survey shall be deducted from the deposit paid by the applicant, and the balance shall De al- j lowed, in account of the first instalment of the rent, the surplus, if any, after satisfaction of the rent, to be returned to the applicant. The rent chargeable on every such license shall be four pounds per acre per annum,. and shall be paid in equal instalments half yearly in advance. A fee shall be paid to the Receiver of Land Revenue on the transfer of such license at the rate of one shilling for every acre contained in the license : Provided that in no case shall f the fee so charged be less than one pound. Every such license shall be drawn so as to terminate on the 31st day of December, in each year. Provided that if the rent having been duly paid, the licensee produces a certificate under the hand of the ranger or other person appointed by the Board to inspect the land, to the effect that none of the provisions of " The Southland Waste Lands Act," or the bye-laws of the Waste Lands Board have been violated, and it is consistent with the public interests, the Board may renew the license for another year, on the original terms and conditions, and so on from year to year. If after the firsts day of July in any year, the licensee being still in occupation of the land, shall neglect to pay the rent within seven days therefrom, the Chief Commissioner shall cause him to be served with a netice demanding immediate payment of the; half yearly instalment of the rent, arid if after seven other days from the service of the notice the rent shall still remain unpaid, it shall be lawful for the Board to issue a warrant directed to a constable to levy the amount so due together with the expenses of the process, by distress and sale of a sufficient part of the plant and machinery or other goods and chattels of the licensee, in like manner as in case of rent in arrear between landlord arid tenant. GrENEBAL. If any person holding a license to cut timber whether by hand or machinery, shall be proved before the Board to have offended againisrlj any regulations herein contained respecting timber, or to have wilfully or negligently injured or destroyed by fire or otherwise any timber belonging to the Crown, such license shall be, and shall be immediately declared to be forfeited, and it shall be at the discretion of the Board to refuse to allow the issue of another license to the some person. ......
