(Before I. Newton Watt, Esq., E.M.) FEIDAY, 27th JULY, 1866. SMITH T. BAEBO^. This was a claim for a bag of sugar, valued at sfd per ib. Plaiutift is a carter, and was desired by defendant, who keeps an accommodation-house and store at the G-reen Hills, to procure for her from Cochran & Granger's, 50 lbs. sugar at s|d. Plaintiff could not procure it under s£-d. On the same day be procured from Wright's another bag of sugar of the weight of 70 lbs., and at the price of of d, for anothor party at the Green Hills. By mistake the wrong bags were delivered to each. Plaintiff said defendant had offered to pay for 70 lbs at 5Jd., but he had refused to take it. Defendant said she had offered to pay for 70 lbs. at 5f d. ; that she was a married woman, and that her husband should have been sued and not her. The plaintiff was non-suited. The Magistrate remarked that it appeared that she was carrying on a business independent of her husband, who was on the West Coast ; her plea would render people cautious in trusting her. MONDAY, 30th JULY. "William Huston, a seaman of the steamship " Phoebe," was charged by the mate, with misconducting himself on board the ship. The charge was dismissed. William Euston was then charged with using obscene language in the public street- Fined twenty shillings, in default of payment, 7 days' imprisonment, with hard labor. James Finegan, a seaman of the Phoebe, was charged with disobedience to lawful commands. Sentenced to 4 weeks imprisonment with hard labor. James Finegan was then charged with using obscene language in the public street. Fined 205., in default, 7 days' imprisonment, with hard labor. James Finegan was then charged with resisting, and assaulting police constable Tuohy in the discharge of his duty Fined 405., in default, one month's imprisonment, with hard labor. James Finegan was then sued for forty shillings, the amount of damage done by Mm to the lock-up. Judgment for 40s.
