Mondat, 7th November, 1864. . (Before H. M'Culloch, Esq., R.M.) Drunkenness. — John Condill and Fleming Barr were each fined ss. for this offence. Assaulting a Constable. — David Stewart, for assaulting a constable whilst in the execution of Ms duty, by kioking and striking Mm, waa fined in the sum of £5. Stealing Firewood:— Francis Simpson was charged with the theft of firewood of the value of 25., the property of Mr. Peters. j %rgeant Forster proved the arrest of the priS2*r\ and prosecutor deposed to having missed repeatedly pieces of firewood from his yard. Prosecutor'identified the wood from marks of paint being upon the pieces. The prisoner said he had known nothing of the •wood, and that he came down from the Makarewa only on Saturday night. The Bench dismissed the charge for want of sufficient evidence. j I>isdmdeely. — A iormAe HanieA Annie Oanipbell was brought up on a charge o£ being an idle and disorderly person, and on the evidence of the arresting constable, waa sentenced to one month's imprisonment, with hard labor. Disorderly House. — Mary Ann O'Brien was informed against as being the keeper of a house of a disorderly character. Detective-otßcer Thompson witnessed to the character of the house and its inmates, and the case being fully proved, The accused was sentenced to two month's imprisonment, with hard labor. Civil Cases. &eisow v. chapman. Mr. Macdonakl for plaintiff, who appeared for tho Education Committee. This action was to recover 153. for educational Msessment. Judgment for plaintiff, with costs. BRACKEN T. TAYLOR SMITH. Claim for £93 2s. 6d., as share (3-oths) of the proceeds of a whale which had been caught at Stewart's Island. PJaintiff deposed to an agreement that defendant waa to have 2-sth.j. and. bAmsalf 3-sths. Defendant hai not accounted for any part of the proceeds. Witnesses were called to prove the accuracy of th\3 statement. Defendant did not appear. Verdict for amount •with costs. GKBRATTY T. TATLOB SMITH. Mr. Macdonald for the plaintiff. No defence. Claim for £12 for share of proceeds of whale, belonging to plaintiff, and sold to defendant. Verdict for amount, with costs. MILLER AND CO. V. SOUTH. Claim for £19 95., for goods sold and delivered. Mr. Harvey prosecuted, and defendant appeared in person. Defence was " not indebted," beyond sum paid into Court, £15 13b. Judgment for £15 13s. -■ ■ .«■■'■ _ — «
