Saturday, 29th Octobee, 1864 (Before H. M'Culloch, Esq., R.M.) Civil Cases. SallTH T. BEENDSTOK. Claim for work done. Amount, £5. Defendent pleaded "not indebted," the work not being performed according to contract. The work in question was the making of rollers for a flax machine. Plaintiff submitted the rollers were made as well as his appliances would permit, and defendant insisted that they should present a true surface the one to the other, and that this was agreed upon between the parties. The evidence on the whole was very conflicting. The Magistrate found the balance of proof in favor of the plaintiff, and gave judgment accordingly, with costs. The Court then rose.
