RESIDENT MAGISTRATE'S COURT.
TtTESD at, 25th October, 1864 (Before H. M'CiMoch; Esq., KM.) . Assault. — Wm. Cavanagh ■ was brought up for this offence, on the person of. H. Smith, the sexton of the Cemetery, on the Dunedin Road, on the evening of Saturday last. H. Smith,. the prosecutor, gave evidence as to the nature of the assault. ;. — Dr. Young then gave ; evidence respecting .the nature of the injuries inflicted. . The case was then adjourned for another day to allow the prisoner to be defended. ,•; The Court then rose. ■ .

There could tie no doubt that an assault had been committed,, but being much in liquor at the tune the prisoner mistook the prosecutor for ebmc v orie else to whom he owed a grudge. , J . ],".':. .• J • ' The prisoner pleaded " guilty." • ■ Mr. N. Chalmers then : gave evidenca of the hitherto steady and respectable character of the "prisoner, who had- been— in». his ewn and his brother's employment for a, period of six years.
