RESIDENT MAGISTRATE'S COURT.

Thursday, Bth Septeiibek, 1864. (Before H. M'Culloch, Esq., R.M.) This was a blank day in both civil and criminal business. Feiday, 9th September, 1864 One drunk and disorderly character was fined 20s. Another person, for being drunk, was fined ss. Theft ov Potatoes. — John Jones was charged with this offence, on the evening of the Bth inst. The prisoner pleaded guilty. The arresting constable gave evidence of the capture. The potatoes were since identified as the property of Mr. Cooper. He was sentenced to six weeks' imprisonment, with hard labor. Civil Case 3. Moeller v. Browx. — Claim for goods supplied. Verdict by consent of parties, with costs 11s. Robeetsox v. Feaser. — Claim for £4 63. 6d., for bread delivered. Verdict was awarded for £3 ss. 6d. and costs. Peat v. Grieve. — In this case a verdict was given for plaintiff for £27, to cover all expenses, including verdict of a former action for the value of a bullock lost through the action of defendant. TARLTOS V. COtTSIXS. This was an action to recover £2, an advance of salary made to defendant from the Provineiivl Treasury. Mr. Macdonald appeared for the prosecution. Defendant insisted that the advance was not made on account of salary, which had since been paid in full, and also put in several ciaim.3 against the Provincial Government as a set-off. It was held by the Court that the Treasury was not liable for those claims till they had been passed and authorised for payment by the Superintendent. Verdict for the amount with 7s. costs. Tho Court then adjourned.
