RESIDENT MAGISTRATE'S COURT.
Moxdat, 22nd August, 1864. (Before H. M'Culloch, Esq., R.M.) Theft. — John Buchanan was charged, on the information of Mr. Grarthwaite, with stealing timber of the -value of os. The prisoner admitted having taken the piece of timber, but had no idea ho was committing a theft. He was sentenced to seven daj's' imprisonment. Breach op Footpath Obdinance. — James Johnstone, for leading a horse on the footpath in Esk-street, on the 17 th instant, was fined 20s. Civil Cases. G-baham v. Levy, and Levy v. G-baham. — These two actions were heard together, the one being for work and labor done, and the other for damages for non-completion of contract. Mr. Button appeared for Capt. Levy ; and Mr. Harvey for Gf-raliaru. The plaintiff (Graham), in the one ease sued for the balance of money due him for repairs done to the schooner " John ;" and Mr. Levy sued for damages in consequence of the non-fuLlilment of contract. After a great deal of conflicting evidence on either side, the Court reserved judgment in both cases till Wednesday morning. RoßEitTSOsr v. Godfbet. — Claim for £2 Ba., for bread delivered to the steamship William Miskin. Captain Godfrey not being present, judgment was awarded in favor of plaintiff, with costs. Thompson v. Campbell. — Claim for £18 9s. 6d., for board and lodging. No defence. Verdict for amount, with costs. The Court then adjourned.
