This was a case arising out of a disputed item of 255. for a set of china. . Mr. Cunningham, for the plaintiffs, deposed to selling to Mrs. Russell, in company with Mrs. M'Donald, the goods at the price sued for.Mr. Russell, the defendant, said that Mrs. Russell and Mrs. M'Donald only went to look at the articles, and not to bargain for them, as he himeelf had already done so with Mr- Chapman. He further stated that he had bought of Mr. Chapman a set for 455., but on sending for them next day, he iound the goods had been: sold to some one else. He then agreed to buy an odd. set, at a proportionate price to that arranged in his first bargain.Avhich Mr. Chapman agreed to. Mr. Chapman stated that defendant in the first sale did not comply with the conditions of sale, and the goods were accordingly sold. 21s. was offered by another" party for the..china-.now in question ; but when Mrs. Russell called, the agreement price was fixed at 255. Mr. Button, who defended the case, applied for tvn adjournment, in order that the evidence oi Mrs. Russell and Mrs. M'Donald might be had. The case was accordingly remanded till the following morning. NIXON AND BEOWN V. M'OANK. Claim for £5 4s. 6d., for balance of wages for work done. No defence. Verdict for plaintiff, with eotts. The Court then rose.
