I Thttesday, 21st July, 1864. (Before M. Price, Esq., RM.) Robert Castles was fined 20s. for a breach of the peace. Two drunkards were mulcted m the penalty of ss. each. Civil Cases. Middleton v. 'Small.— Claim for £12 13s. 9d. for money lent. No appearanoe of defendant. Verdict, by default, in plaintiff *s favor for amount, and costs. BUTTKBB AKD HALLEirSTEIN* V. M. SALEK.— t Claim for £67 ss. 9d., on a dishonored bill. Defendant applied for a postponement of the l case, in order that Iris solicitor, who was- engaged elsewhere, might be present to conduct his case. He also objected to the hearing of the case at present, as an action was now pending at the instance of, the plaintiffs, for conspiracy, to de-fraud, for the sum now sued for. The Magistrate stated that the easiest way to: acquit himself, of the charge of conspiracy was to settle the claim at once, and as defendant admitted the debt, he -could not do otherwise than award fbr the, amouut in favor of the plaintiff. t Verdict accordingly. Same v. Mend oza.— Action to recover amount of £100 on a dishonored bill accepted by M. Salek, and endorsed by defendant.'Defendant pleaded that no, consideration; had, passed between Salek and him ; but he would pay the claim if certain securities lodged with the plaintiffs were handed over.to him. Th^ Magistrate - said defendant was clearly liable, but said he had a remedy 'against Salek. Mr. Mendoza intimated that he would appeal to the Supreme Court, ; against the decision. , ... ; Psice v.
