RESIDENT MAGISTRATE'S COURT.
Thttrsday, 7th Jtti.t, 1864. . - (Before M. Price, Esq., R.M.) One drunkard was brought up, and fined in the penalty of ss. Crvir. Cases. Hakgik axd Co's Trustees v. G. Smith.— This was a remanded case, to allow plaintiffs to have the work, payment for which was now sued for, completed. The defendant, on this occasian, -made no appearance, and plaintiffs, giving evidence as to the work being finished, a verdict was given in their favor. CTJTHBEBTSOX BBOTHEBS V. DALGETT, BATTBAY AICD CO. This was an action to recover the sum of £50, being the price of 600 lbs. sheepwash tobacco, sold by plaintiffs to one D. Johnston, as manager on the" Wairaki Station. Mr. Button appeared for the plaintiffs/and Mr Harvey for defendants. Mr.'Cuthbertson gaTe evidence to the eflect that the goods were delivered in April, 1863. The account was certified by Mr. Johnstone, who gaye an order on Messrs. Dalgety, Rattray and Co. for the amount. When witness saw Mr. M'Donald (of Mossrs. D.. R.. and Co.") he was told that the account required to be sent to Dunedm, for the purpose of being approved of by Mr. Ratrrav. At this stage of the case, Mr. Harvey said that some misunderstanding had existed as to the time when Johnstone was authorised to order goods in the name of his employers. This, however, he was instructed to say, was now explained, and he would confess a judgment against the defendants. The Bench awarded a verdict in favor of plaintiffs, with £8 17s. of costs. The Court then adjourned till eleven o clock on the following day.
