Short Title of this Act shall bo " The Cattle Act, 1861." appoint Itispsctors. The duties of an Inspector of Diseased shall be as follows :— When any ship or vessel having cattle on board, shall arrive within any such port o£pl ace in the Colony, the Inspec- . t°«*ahaU forthwith, or as soon as conveniently can be, go on board such ship or vessel, and by inspecting such cattle. or otherwise satisfy himself whether such cattle or any of them are -.or may be reasonably suspected to be infected with any infectious disease or whether the same are free from infectious disease. •) If such Inspector shall be satisfied that such cattle are free from infections disease, and were not ■ imported from any district where infections disease shall be known to prevail, he shall give to the master of such ship orvessel, a certificate to tbe effect, after which certificate so obtained, but not before, such cattle may be landed. If such Inspector shall be satisfied that such cattle, or any of them, are actually infected with such disease, he shall forthwith give notice to that effect to the master of such ship or vessel/ and it, shall be the duty of such master within 24 hours after such notice, to destroy the same without suffering the same to be landed. o*o If such cattle'shall have been imported from any district where infectious disease shall be known to prevail, or if '*.'. such Inspector shall have reasonable ground to suspect that the same cattle or any of them are infected with such , disease, be may- give such master a certificate to. that effect, (to by termed a quarantine certificate), and shall V therein specify some place at which the | same cattle may be lauded/and some i H place to which the same may be driven, H ■-.-.. to be appointed by .the Governor for a H quarantine ground at or near the said ■ port or place, after which certificate so H. obtained the said master may land such H cattle, or cause the same to be landed at H. . such place so named in such quarantine ■ certificate, bnt nt no other place; and I may drive such cattle, or cause the same I to be driven to the said place so ap- ■ pointed asa quarantine grouud, but to I no other place, and no master of such ■ ';..* ship or vessel shall permit or suffer such B cattle to be so landed or driven otherwise than in accordance with such quarantine certificate. (eS) Tbe Inspector shall make a report from ■:■'., time to time of all things done by him under this Act, wliich report shall be made in the first instance to the Superintendent of such Province, nnd shall by him be transmitted to the Governor. Governor to appoint Quarantine grounds. 5. The Governor may by any Order in Council from time to time appoint places for quarantine grounds under this Act, and may make regulations for the management of such quarantine grounds, and fixing the fees and charges thereof, and for the destroying of diseased cattle, and for the landing and driving of cattle under this Act, and generally for regulating and enforcing the performance of the duties hereby imposed on Inspectors aud on • masters of ships or vessels. Lispectors' Fees. 6. The Inspector of Diseased Cattle shall be entitled to a fee of two and sixpence for every -..,' head of cattle on board any ship or vessel which shall be inspected by hira as aforesaid, which fee shall be paid on demand by suoh master to such Inspector, provided that no greater sum in the aggregate than £10 in respect of cattle brought by any one ship or vessel shall be so payable. Copy of Acts to be furnished to Masters of vessels. 7. When any vessel or ship, having cattle on board, shall arrive in any port or place within the colony, it shalllhe duty of the Harbor Master or.. Collector of Customs, or some person to be appointed in that behalf by the Governorat such port or place immediately to furnish the master of such ship or vessel with a copy of this Act, and also to give information to the Inspector of Cattle of the arrival of such ship or vessel. Penalty for landing cattle. 8. Every master of a ship or vessel who shall land, or suffer to be landed, any cattle without having obtained such certificate as aforesaid, or shall refuse or neglect to destroy cattle according to any such notice as aforesaid, or shall otherwise offend against the provisions of this Act, hereinbefore contained, shall forfeit aud pay any sum not exceeding £500. Governor to declare prohibited Ports. 9. If at any time it shall beruade to appear to the Governor that any infectious or contagious disease has broken out in any district out of the colony, it shall be lawful for the ""Governor, by Order in Council, to declare that „ such district is infected within the meaning of tbis Act, and from time to time to make such regulations as to him shall seem fit, for prohibiting the -importation of cattle into the Colony from such district, and the landing or driving of such cattle, and for destroying cattle imported, landed, or driven contrary to such regulations. Inf ected Cattle in tlie Coleny mag be destroyed. 10. If at any time it shall be made to appear ; to the Governor that any infectious or contagious disease has broken out amongst cattle in any district of the colony, it shall be lawful for the Governor, by Order in Council, to declare that such district is infected, within the meaning of tbis Act, and from time to time to make such regulations for destroying diseased cattle therein, and for prohibiting the removal or transportation of cattle from one part of the Cblouy to another, and for preventing the" further spread of such disease as to 1 him shall ; seem fit. y" ~ Regulations and appointments to be published 11. regulations made by the Governor under authority f of -this Act shall be published in the General Government Gazette and all regulations and appointments made by the Superintendent of any Province; in pursuance of any power delegated to him under the power of delegation hereinafter contained, shall be published in the Govemwent. Gazette of such Province -and aU such regulations being so published shall; have the force of law. Tenalties for breach of regulations. 12. Any person guilty of any breach of such A regulations as aforesaid, shall be liable to such penalty as shall he expressed in such regulations f not exceeding agoOO. Penalties under this Act or under the i regulations authorised by this Act, may be recovered in a summary way before any Resi- ; dent Magistrate, or any two Justices of ihe Peace, for the sue of Her Majesty by any person who may sne for the same. Governor, may delegate powers to Superintendents. 14. The Governor in Council may by warrant under his hand, from time to time delegate to theSuperintedent of any Province within the 9 said Colony, all or any of the powers vested in
the Governor, or tliß Governor in CoUticil by this Aot subject to subh reflations as he may think fit, aiid i may from time to time rescind suoh delegation, Interpretation. V 15. In the Interpretation of this Aot theward '* Cattle" shall mean and inolude Neat Cattle whether living or dead, and parts oif sucluoattle, The word "District '» shall as regards the Australian colonies, mean and include tho ' entirety of the Colony; and all Colonies and! extra-ooloniaf places,- immediate]/ adjaoent thereto/ The' words "infections disease" or " contagious disease " throughout this Act shall mean and Include the disease called Pleuropneumonia, aud every other disease commonly reputed to be contagious or infectious. Imdemnity. to Superintendent of Canterbury, i 1.6. And whereas an Ordinance was lately passed or purported to have been passed by the Superintendent and Provincial Council of the Province of Canterbury, for prohibiting the importation of diseased cattle, but before the passing thereof the said Gpuncil was dissolved, and the said Ordinance has been expressly disallowed by the Govern er. And whereas Acts may have been done or authorised or permitted to be done by the Superintendent of the said Province, under the powers of the said Ordinance before receiving notice of tlie disallowance of such Ordinance. 6e it enacted by the General Assembly of New Zealand, and by the ' authority aforesaid, that the said Superintendent shall be, and he is hereby released and indemnified from and against all actions, suits, claims, and demands whatsoever, by reason or on account of any Act, matter, or thing done, authorisd or permitted by him, according to the provisions of the said Ordinance, before receiving notice of the disallowance of such Ordinance. ""*■ Commencement of Act. 17. This Act shall come into operation on such day as shall be fixed by the Governor, whereof proclamation shall be made and published ..In the Government Gazette.
