THE DISEASED CATTLE ACT.

An Act to prevent the Importation of Diseased Cattle. (Passed sth Septemseis. 1 £(>!.) Be it enacted by the General Assembly of 2?ew Zealand in Parliament assembled, and hy ths authority ofthe same as follows .- — Short Title. 1. The Short Title of tbis Act shall be '•' The Diseased Cattle Act, 1561." Governor to appoint Inspectors. 2. The Governor shall from time to time np • point proper persons at such ports and places as to him shall seem fit to be Inspector of Dis eased Cattle, to perform tho duties required by this Act, and may from lime to time remove persons aud appoint other persons in t heir respective places. To be notified. S. Every such appointment shall be by warrant, under ..thb hand uf the Governor and every /such appointment and removal shall be notified in the Government Gazette of the colony. Duties of Inspector. 4. The duties of an Inspector of Diseased Cattle shall be as follows :-- (a.) When any ship or vessel having caltlo on board, shall arrive within any such port or^plaee in the Colony, the Inspect'orshall forthwith, or as soon as conV .-" vij>niently can be, gn onboard such ship or vessel, and by inspecting stich cattle or otherwise satisfy himself whether such cattle or any of them are or may be reasonably suspected to be infected with any infections disease or whether the same are free from infectious disease. (&•) If such Inspector shall be satisfied that such cattle afe free from infectious disease, and wore not i-.oported from any district where infections disease shalt be i known to prgvail, he shall give to the J master of such ship or vessel, a certi- j ficate to the effect, after which certificate j . - so obtained, but not before, such cuttle j may be landed. i (c.) If such Inspector shall be satisfied that .such, cattle, or any of them, are actually infected with such disease, he' shall forthwith give notice to lhat effect to the master of suoh ship or vessel, and S^~ it shall be the duty of such master : within 24 hours after such noiice, to the same without suffering the sSijne to be landed. (&) The liispeotor shall malce a report from time to time of all things done by him under this Act, which report shall be made in the first instance to the Superintendent of suoh Province, and shall byJiim be transmitted to the Governor. Governor to appoint Quarantine grounds, 5. The Governor may by ariy Order in Council from time to time appoint places for quarantine grounds under this Act, and may malce regulations for the management of such quarantine grounds, and fixing the fees and charges thereof, and for tlie destroying of dis;eased cattle, and for the landing and driving of cattle under this Act, and generally for regulating and enforcing tho performance of the duties hereby imposed on Inspectors and on masters of ships or vessels. Injectors' Fees.. 6. The Inspector of Diseased Cattle shall be entitled to a fee of two and sixpence for every head of cattle on board any shipbr vessel which shall be inspected by him as aforesaid , which fee shall be paid on demand by such master to such Inspector, provided that no greater sum in the aggregate than £10 in respect of cattle brought by- any one ship cr vessel shall be so payable. Copy of Acts to be furnislied to Masters of vessels. 7. When any vessel or ship, having cattle on board, shall arrive in any port or place within tlie colony, it shall the duty of the Harbor Master or Collector of Customs, or some person to be appointed in that behalf by the Governor at such port or place imniediately to furnish the master of such ship or vessel with a copy of this Act, and also to give in f"rrn ation to the Inspector of Ciljle of the arrival of such shij) j or vessel. Penalty for landing caitle. S. Every master of a ship or vessel who shall laud, or suffer to .be landed, any cattle without having obtained such certificate as aforesaid, or shall refuse or neglect to destroy cattle according to any such notice as aforesaid, or shall otherwise offend against the provisions of this Act, hereinbefore contained, shall forfeit and piv any sum not exceeding £500. Governor to declare prohibited Ports. 9. If at any time it shall be made to appear to the Governor that any infectious ov contagious disease has broken out in any distiict out of the colony, it shall be lawful for the Governor, by Order in Council, to declare that such district is infected within thn meaning of this Act, ancl from time to time to make such regulations as to him shall seem fit, for prohibiting the importation of cattle into tho Colony from such-district, and the landing or driving of such cattle, und for destroying cattle imported, l..nded, or driven contrary to such regulations. If at i\ny time it sh ill be made to appear tn the Governor that auy infectious or con la gious disease lias broken out amongst cattle in any district of tbe colony, it shall be lawful for the Governor, by Order in Council, to declare | that such district is infected, within the meaning of this Act, and Irom time tv time to make I such regulations for destroying diseased cattle thevcin," and for prohibiting the removal or transportation of cattle from oue pari of the Colony to another, and for preventing the further spread of such disease as to him shall seem fit. R?ff illations and appointments to bo published - 11. All regulations made by the Governor under authority of this Act shall be published in the Genc"al Government Gazette and all regulations and appointments made by the Superintendent of any Province, in pursuance of any power delegated to him under the power of delegation hereinafter contained, shall be published in the Government Gazette of such Province aud all such regulations being so published shall have ihv force of law. Penalties for breach of regulations, 12. Any person guilty of aiiy breach of such regulations as aforesaid, shall bo liable to such penalty as shall be expressed in such regulations not eNCeeding £500. Penalties — hoic recoverable. 10. Penalties under this Act or under the regulations authorised by this Act, may be recovered in a summary way before any Resident Magistrate, or any two Justices of the Peace, far the sue of Her Majesty by any person who may sue for the same. The Governor in Council may by warrant under his hand, from time to time delegate to the Snperintedent of any Province within the said Colony, all or any of the powers vested in tiie Governor, or the Governor in Council by this Act subject to such regulations -as he may think lit, and may from time to time rescind such delegation, Interpretation. 15. In the Interpretation of this Act the word " Cattle" sh ill mean and include Neat Cattle whether living or dead, and parts of such cattle. The word " 13istrict " shall as regards the Australian colonies, mean and include the entirety of the Colony, and all Colonies and extra-colonial places immediate]./ adjacent thereto. The words " infectious disease " or " contagious disease " throughout this Act shall mean and inclnde the disease called Pleuropneumonia, and every other disease commonly reputed lo be contagious or infectious. And whereas an Ordinance was lately passed or purported to have been passed by the Superintendent and Provincial Council of the Province of Canterbury, for prohibiting the im- [ portation of diseased cattle, but before the passing -thereof the said Council was dissolved, and the said Ordinance lias been espi-pssly dis allowed by the Governer. And whereas Acts m.iy have been done or authorised or permitted to be done by the Superintendent, of the said Province, under the powers of the said Ordinance before receiving notice of the disallowance of such Ordinance. Be it enacted by the General Assembly of New Zealand, and by the authority aforesaid, that the said Superintendent shall be, and he is hereby released and indemnified from and against all actions, suits, claims, and demands whatsoever, by reason or on account of any Act, matter, or thing done, authorise! or permitted by him, according to the provisions of the said Ordinance, before receiving notice of the disallowance of such Ordinance. Commencement of Act. 17. This Act shall, come into operation on such dav as shall be fixed" by the Governor, whereof proclamation shall be made aud published in the Government Gazette.
