WHEBEAS by Deed of N fourth day of July, ;One^thoimnd e'ett hundred and sixty-three, Ferdinand Augustus Von Hammer, of Invercargill, in* the Province/ of Southland, Livery Stable Keeper, assigned all. his estate and effects unto Archibald Thomas Manning and Samuel Beaven, both of Irivercargill v" aforesaid, merchants, as trustees, m trust- to sell such estate and effects, and after payment of epcpenses, to pay and satisfy, so far as the trust monies will extend to the creditors of the said " Ferdinand Augustus Von - Hamir er, who. shall by themselves, or their attorneys, or agents; or in the name or names of their paitnership, : jointly execute the said deed, the amount of the debts due or owing to them respectively from tbe said Ferdinand Augustus Von Hammer, rateably v and proportionably, and without any" prefereife* or priority, but subject to the provisions thereinafter contained, which said deed now lies at the office of S. NOTICE IS HEEEBY GIVEN, that Francis Hamilton, of Invercargill, in the Province of Southland, Auctioneer, Stock, Station, and Commission Agent, did, hy deed bearing date the tenth day of June, 1863, grant, convey, and assign unto Henry William Whitton, of Invercarj gill, Merchant, and John Blaeklcck, of ? the same place, Merchant, all the estate and effects of him, the said Francis Hamilton, upon the trusts therein mf ntioneil, for the benefit of all the creditors of tbe said Francis Hamilton ; and that the said deed was duly executed by the said Francis Hamilton on the said tenth day of July, 1863, and by the said H. W. Whitton and John Blacklock, on the fifteenth day of June aforesaid, and the execution of the said deed by the said Francis Hamilton, H. W. Whitton, and J. Blacklock, was attested by James Harvey, of Invercargill, aforesaid, Solicitor ; and that the said deed now lies at the oflice of Messrs. Harvey and Stuart, Solicitors, Tay-strcefc, Invercargill, aforesaid, for the perusal and execution by the creditors of the said Francis Hamilton, and who will be excluded from all benefit under the said deed unless they execute, or assent in wriing to take the benefit ol the same, on or before the fourth day of August next. TENDERS ARE REQUIRED BY THE GOVERNMENT OF NEW ZEALAND FOR THE PERFORMANCE OF THE UNDERMENTIONED SERVICES. "I A Steamer to leave Melbourne within twenty. -*■ • four hours after the due drte of the arrival of the European Mail Contract Boat, for Port Chalmers, Otago, calling at the Bluff. To wait in Melbourne for the Mail, if detained, not more than four days, after its due date. 2. A steamer to leave Port Chalmers for Melbourne, calling at the Bluff, carrying the Homeward Mail of the Colony to Melbourne not later than two p.m. on the 16th of each month, except February, and then on the 14th. The steamers emploj-ed must be subject to the approval of the Government, and must be able to maintain an average speed of not less than eight knots an hour on each voyage. All Post Office Mails must be received on board ; and delivered to destination free of charge. .. -■;-. Mails to be taken from and delivered on board ' of the European Mail Contract Steamer* in Hobson's Bay, flt the expense of the contractor. A free chief cabin passage must be at the service of a clerk or agent of the Post Office, on the requisition cf the Government, and proper accommodation provided for sorting letters. The tender to state the amount of penalty recoverable for general non-performance of contract; a penalty of £100 per diem will be required for delay in departure after the time fixed on each voyage, and an additional penalty of £300 for failure, after such delay in delivering the homeward mail in Melbourne prior to the departure of the European Mail Contract Boat from that port. The tenders may state the sum for which the whole or any portion of the forementioned services will be undertaken. The contract to commence on January Ist, 1864, and to continue in force until the expiration of six calendar months' notice to be given by either of the parties to the other of his intention to determine the same; provided always that the contract shall not termiuate before the 31st day of December, 1864. The tenders to be endorsed "Tenders for the New Zealand Mail Services," to be addressed to the Postmaster General of New Zealand, and to be posted at Dunedin not later than the 18th day of September next.
